AGREEMENT BETWEEN USER AND Mahabah

Eligibility

1. You must be at least 18 years old to use our services. By using our services, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions set forth herein.

Membership

1. To become a member of our organization, you must complete our application process, which includes providing personal information, such as your name, email address, phone number, and other personal information including your picture. You must also provide accurate and complete information, and you agree to update your information if it changes.

Fees

1. Our organization is a non-profit organization, and our fees are reasonable and based on suggested donations. We also accept donations to support our mission and improve our services. Our Membership packages can have different minimum donation amount. 

2. You are responsible for payment of our service, which can be made through online payment methods such as Paypal, debit or credit cards that belong to you or which you are authorized to use. Payment must be received prior to commencement of service and again following the completion of the previously agreed payment term if you require continued use of our service.

3. Please note that we do not provide refunds. Refunds will not be given in cases where a match has not been found or where a match has not worked out despite our best efforts. Once payment has been made, it is non-refundable in all circumstances, whether in whole or in part. When you make a payment, you are agreeing to donate the money to our organization. 

Matchmaking Coaching Services

1. Our matchmaking coaching services are designed to help you start a healthy marriage. We will provide you with personalized coaching based on your relationship goals, preferences, and other factors. Our services include a combination of online coaching and group online meetings.

2. Coaching Sessions will be conducted via video conferencing or phone, and will be scheduled in advance based on mutual availability. The content of the coaching sessions is intended to be educational and informative, and it does not constitute mental health or professional counseling advice.

3. We guarantee that none of the video conferences with our clients will ever be recorded, ensuring your privacy and confidentiality.

Access to Singles Network and Events

We will match you through our network of singles and events that are specifically designed for individuals who are seeking marriage. You acknowledge and agree that we do not guarantee that you will find a suitable match or that any particular match will result in a long-lasting relationship.

Confidentiality

We hold your privacy in the highest regard and are dedicated to maintaining the confidentiality of your personal information. In certain cases, we may internally discuss your personal information within our team to enhance the quality of our services to our valued clients. Your trust in us is of utmost importance, and we take every measure to safeguard your privacy.

Use of Personal Information

We may use your personal information to improve our services, communicate with you, and provide you with personalized coaching. Any sharing of your personal information with third parties will always be conducted in strict accordance with your consent, as mutually agreed upon in the client agreement. In order to effectively deliver our services at Mahabah, Inc., we may engage with third-party partners who play integral roles in supporting our operations. These trusted partners, which may include entities involved in matchmaking, payment processing, email marketing, and other relevant functions, could potentially have access to your information as necessary to facilitate the services we provide. Your privacy and security remain our top priorities throughout every aspect of our service delivery.

Protection of Personal Information

We will take reasonable measures to protect your personal information from unauthorized access, use, or disclosure. However, we cannot guarantee the security of your personal information, and you acknowledge and agree that you provide your personal information at your own risk.

Code of Conduct

As a member of our organization, you agree to abide by our code of conduct, which includes the following:

• Respect: You will treat all members of our organization with respect and dignity, and you will not engage in any discriminatory or offensive behavior.

• Honesty: You will provide accurate and truthful information about yourself and your relationship goals.

• Safety: You will take appropriate safety precautions when meeting with other members, and you will not engage in any illegal or unethical behavior.

• Confidentiality: You will keep all information related to our organization and its members confidential.

Termination

We reserve the right to terminate your membership and access to our services if you violate these Terms or our code of conduct, or for any other reason at our sole discretion.

Limitation of Liability

You acknowledge and agree that our organization, its officers, directors, employees, agents, and affiliates shall not be liable to you or any third party for any direct, indirect, incidental, special, or consequential damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of our services.

Indemnification

You agree to indemnify and hold harmless our organization, its officers, directors, employees, agents, and affiliates from any and all claims, liabilities, damages, and expenses, including reasonable attorneys' fees and costs, arising out of or in connection with your use of our services, your breach of these Terms, or your violation of any law or the rights of any third party.

Dispute Resolution

Any disputes arising out of or in connection with these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the United States, and the decision of the arbitrator shall be final and binding on all parties.
